16-year-old Aline Mukamusoni (wrong name) has spent 18 months facing wild corporal torture from her employer. Her skin has changed color due to regular cuts of cables, electric fiber and pipes beaten to her days and nights.
Her boss, Josiane Uwase, is serving a three-year prison sentence having found guilty of torturing the young girl. However, her family has not been satisfied with the court’s decision, and calls for justice.
The Burera-born young girl arrived in Kigali to find a job having dropped out of school at her birth home.
At his arrival, Mukamusoni was hired by Uwase and became her house maid where she started to beat her until her skin changed the color due to wounds caused by corporal torture exercised on her body.
“At any point, as far as it was, I was shot. If, for example, the washed dish was outside, a rainfall was hit on me. My boss did not expect the wounds to stop, they still beat me when they were fraud, “she testifies.
She got beaten naked, regardless of her young age and the whole body is full of cuts and wounds while her boss would ignore that she was damaging her body leading to countless scars.
In an anxious voice, tearing, Aline reveals that her boss intimidated her and took her cellphone, obliging her to tell parents that she was feeling alright. She live such life in a period of 18 months.
On Flash TV’s micros and cameras, Aline deplores the wildness of this unforgiving mother of two children. “Every time she arrived, if something was wrong, it was a blow. She shut me up in her room to tap me. The day she shut the door to leave, everywhere she covered the sheets, I could not stand. ”
“Imagine the cuts in the bleeding wounds. When the blood flowed, she [her boss Uwase] would say, ‘Go and wash yourself in bathroom, do not cause my nausea’ Cold water in fresh wounds was painful. And when I was putting clothes, they could cause pain to me once they touched my wounds”.
She added that by the time of guest at home, she had to wear clothes to hide wounds so the guests would not figure out what happened.
Her maternal aunt guarding her in Kinyinya from Gasabo, argues that there are still cables drawn in Aline’s scars. “It happens to her scratched in the blackish scarves, and when we approach it, we get a few metal wires”.
Josiane Uwase, known as bad neighbor
The information was delivered by neighbors who heard her screaming, a long time since Uwase was doing evil things to Mukamusoni. Every housed who used to work for Uwase is reportedly said to have left to save their lives because their boss was beating them day after day”.
One of the neighbors testifies, “We are not surprised, we know that Josiane’s servants leave her not by mutual consent but because of her evil behavior. They leave disappointed. She is really wild “.
The other reveals that Uwase’s servants never go out, stay indoors. “We could not tell whether the servant is there or not”
On June 19, 2017, one of the neighbors informed security services that Mukamusoni was not safe. They came to see her and found her with a cord of cables upstairs.
According to the neighborhood, Josiane Uwase is a free woman, and some think she corrupts the local authorities to cover her against her torture crimes, especially against children under 18.
On July 17, 2017, the Kacyiru Primary Court held the trial in Kibagabaga and decided that Josiane Uwase will spend 3 years behind the bars and a fine of 500,000 Rwandan francs for just “Bounds and injuries”.
Family, local authorities, neighbors, all appeal for justice
The neighboring community of Josiane’s, Aline’s family and the Kamatamu local authorities, all appealed that the trial proceedings would have been held in Kacyiru, the reported crime scene of the incident, insisting that the sentence charges were not corresponding to Uwase’s crime.

The crime has been misunderstood, it is not [simple wounds and injuries], it is rather torture to a minor, again employed, which is also illegal. Let the trial be revoked “.
Anonymous sources doubt in this trial, speculating bribery to reduce Josiane’s sentence. Others point to an Indian lover who was shooting the trial, as a source of funding behind this impunity.
Legal Framework: Juridictional conflict
According to Me JMV Bizimungu, the lawyer who voluntarily assists Aline, the offense should be submitted to the intermediate couts, as crime is not simply “Bond and Holocaust,” but rather “Torture”.
He says, “The act leaves the body breaking down, the victim is a child under the age of 18, and spent 18 months in agony. It’s a torture “.
Article 176 of the Rwandan Criminal Code (Organic Law no 01/2012) defines torture in these terms.
“Torture means any act by which pain or physical acute, physical or mental, inhuman, cruel or degrading is intentionally inflicted on a person for the purposes of … to punish a person or woman Third person has committed or is suspected of having committed …. “.
The following article (177) of the law determines the penalty for torture. “If it is a result of torture, an incurable disease, a permanent disability of work, either the loss of absolute use of a body or serious mutilation, the sentence is imprisonment of over five (5) to seven (7) years.
As a result, should the appeal be filed, the trial could be revised at the Gasabo Intermediate Court, as stipulated in Article 73 of Law No. 51/2008, relating the organization, functioning and jurisdiction of the courts of justice in Rwanda.
Article 73 states that “The Intermediate Courts only hold cases of people sentenced for more than five years’ of imprisonment”.
